1. Acceptance of Terms

By accessing or using the WebDNS platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and WebDNS.

2. Service Description

WebDNS provides email hosting services, including but not limited to:

• Custom domain email hosting
• Mailbox provisioning and management
• Email alias and forwarding services
• Webmail access
• Spam and virus filtering
• DNS configuration guidance

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorised use of your account.

You must be at least 18 years of age to create an account. By registering, you represent that you meet this requirement.

4. Acceptable Use Policy

You agree not to use the Service to:

• Send spam, unsolicited bulk email, or phishing messages.
• Distribute malware, viruses, or other harmful software.
• Forge email headers or impersonate any person or entity.
• Harass, threaten, or abuse other individuals.
• Violate any applicable local, national, or international law or regulation.
• Infringe upon the intellectual property rights of any third party.
• Transmit any content that is unlawful, defamatory, obscene, or otherwise objectionable.
• Attempt to gain unauthorised access to any part of the Service or its related systems.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy without notice or refund.

5. Payment and Billing

• Subscription fees are billed in advance on a recurring basis according to your chosen billing cycle (monthly, yearly, or multi-year).
• All prices are in British Pounds (GBP) unless stated otherwise.
• Payments are processed securely through our third-party payment processor, Stripe.
• You are responsible for providing a valid payment method and keeping it up to date.
• Failed payments may result in suspension of your Service.
• Refunds are handled on a case-by-case basis. We are not obligated to provide refunds except where required by applicable law.

6. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, during which the Service may be temporarily unavailable. We shall not be liable for any downtime, data loss, or service interruptions.

7. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. You retain ownership of all data stored in your mailboxes.

8. Intellectual Property

All content, trademarks, and intellectual property associated with the Service belong to WebDNS or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

9. Termination

• You may cancel your subscription at any time from your account dashboard. Your Service will remain active until the end of the current billing period.
• We may suspend or terminate your account immediately if you breach these Terms, particularly the Acceptable Use Policy.
• Upon termination, your data will be retained for a reasonable period to allow retrieval, after which it will be permanently deleted.

10. Limitation of Liability

To the fullest extent permitted by law:

• WebDNS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill.
• Our total liability arising from or relating to these Terms or the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.

11. Indemnification

You agree to indemnify and hold harmless WebDNS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
